1. Overview
These Terms and Conditions govern your use of the fromZero2Sixty Strategic Partnership Program and all related services operated by TheViralNetwork Pty Ltd, a company registered in New South Wales, Australia. By registering as a partner you agree to be bound by these terms.
In these Terms, "we", "us", and "our" refers to TheViralNetwork Pty Ltd trading as fromZero2Sixty. "You" and "partner" refers to the approved individual or entity participating in the Strategic Partnership Program.
2. Approved services
As a Strategic Partner you may refer clients to the following fromZero2Sixty services:
- Getting to the Stage (Talk Application Program)
- Speaker Packages — Influencer, Best-Seller, Double Best-Seller, Million Maker
- Media Connector
- Speak2Lead
- Lead Generator
- YouTube Channel Formula
We reserve the right to add, modify, or remove services from the approved list at any time. Partners will be notified of any material changes.
3. Partner registration and approval
All partner applications are subject to manual review and approval by our team. Submission of an application does not guarantee approval. We reserve the right to decline any application without providing a reason. Upon approval you will receive a unique referral link and access to the partner portal.
4. Referral process
To receive commission credit, referrals must be submitted through your unique partner link or introduced directly via our approved process. Referrals that cannot be attributed to your account will not qualify for commission. We are the final authority on whether a referral qualifies.
5. Commission structure
Commission is calculated monthly based on the total gross spend of your referred clients in that calendar month:
- $0 to $5,000 in referred spend per month: 10% commission
- $5,001 to $10,000 in referred spend per month: 12.5% commission
- $10,001 and above in referred spend per month: 15% commission
Commission tiers reset at the start of each calendar month. Payouts are processed quarterly. Custom commission rates may be agreed in writing for select white label partners and will override the standard tier structure.
6. Payment terms
Commission payouts are processed at the end of each quarter (March, June, September, December) and are subject to a 30-day validation period following the close of that quarter. Payments are issued via PayPal, Payoneer, Wise, or another method agreed in writing.
We reserve the right to withhold commission payments where there is a dispute, suspected fraud, or breach of these Terms. Commissions are calculated on gross client spend and do not include refunded or disputed amounts.
7. Client cancellations
Referred clients may cancel their services at the end of any calendar month. Cancellations mid-month are not permitted. Commission will not be payable on spend from a client who has cancelled their services for a given month.
8. Marketing and branding
Approved partners may use only marketing assets and language provided or approved by us in writing. You must not misrepresent our services, make guarantees we have not authorised, or use our brand in a way that could cause confusion or reputational harm.
Use of the TED or TEDx trademarks must follow TED's public usage guidelines. You must not imply any official affiliation, endorsement, or partnership with TED Conferences LLC or the TEDx program.
9. Program conduct
Partners must conduct themselves professionally and ethically at all times. We reserve the right to revoke Strategic Partnership status immediately and without notice if there is any misuse of our branding, deceptive marketing practices, harassment of clients or staff, or any breach of these Terms.
10. Confidentiality
You agree to maintain strict confidentiality regarding our internal processes, pricing structures, client data, and any proprietary information you access as a partner. This obligation continues after the termination of your participation in the program.
11. Term and termination
Participation in the Strategic Partnership Program is at-will and may be terminated by either party with written notice. Upon termination, commissions for active referrals made prior to termination will be honoured for up to 90 days, subject to the 30-day validation period and these Terms.
We may terminate your participation immediately and without notice in the event of a breach of these Terms.
12. Limitation of liability
To the maximum extent permitted by law, TheViralNetwork Pty Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your participation in the Strategic Partnership Program. Our total liability to you shall not exceed the total commission paid to you in the three months preceding the event giving rise to the claim.
13. TED disclaimer
fromZero2Sixty and The Viral Network are independent of TED Conferences LLC and its affiliates. We are not affiliated with, endorsed by, or officially connected to TED or TEDx in any way. TED and TEDx are registered trademarks of TED Conferences LLC. Our services are designed to help speakers amplify the reach of their independently produced talks and ideas.
14. Governing law
These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
15. Amendments
We reserve the right to update these Terms and Conditions at any time. All active partners will be notified of any material changes by email. Your continued participation in the program after any changes constitutes acceptance of the updated Terms.
